Agreement

By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, which is incorporated here by reference.

We may amend these Terms where the amendment benefits users, or where it is consistent with the purpose of these Terms and reasonable in the circumstances. Where we amend them, we will announce the fact of the amendment, its content, and the date it takes effect on the Site before that effective date. Amendments take effect on the stated date.

Eligibility

The Site is intended for business use by individuals aged 18 or older. By using the Site, you represent and warrant that you meet this eligibility requirement and have the legal authority to enter into these Terms on behalf of yourself or the organization you represent.

Permitted Use

You may access and use the Site for lawful business purposes — to learn about Aloha Intech, its ventures, and its services, and to contact us through the provided channels.

Prohibited Conduct

You must not use the Site in any way that:

• Violates any applicable Japanese law or regulation, or the laws of your jurisdiction
• Infringes the intellectual property rights of Aloha Intech or any third party
• Involves scraping, crawling, or automated data collection without our prior written consent
• Introduces malware, viruses, or any harmful or disruptive code
• Attempts to gain unauthorized access to any part of the Site or its underlying systems
• Misrepresents your identity or affiliation with any person or organization
• Interferes with the operation or security of the Site
• Is carried out by, or on behalf of, organized crime groups or other antisocial forces (反社会的勢力)

We reserve the right to block or restrict access to the Site for any user who violates these Terms, without notice.

Availability and Changes to the Site

We may change, suspend, or discontinue all or part of the Site — including for maintenance, technical faults, or reasons beyond our reasonable control — at any time and without prior notice. We are not liable to you for any change, suspension, or discontinuation of the Site, except as set out in section F.

Ownership

All content on the Site — including text, design, graphics, logos, icons, and the arrangement thereof — is the exclusive property of Aloha Intech LLC or its licensors and is protected under applicable copyright law. "Aloha Intech", "Ossu Automate", "Ossu Create", and "Ossu Reality" are trademarks of Aloha Intech LLC.

Restrictions

No content from the Site may be copied, reproduced, distributed, published, or used in any manner without our prior written permission, except as strictly required to view the Site in your browser. Nothing in these Terms grants you any license or right to use any trademark or trade name of Aloha Intech.

Non-Confidential Submissions

General ideas, suggestions, and feedback you send us about the Site or our services are treated as non-confidential, and you grant us a non-exclusive, royalty-free license to use them. This does not apply to information you identify as confidential, or that is plainly confidential from its nature or context — such as details of your systems, projects, or commercial requirements sent as part of a business inquiry. We treat that information as confidential and use it only to evaluate and respond to your inquiry.

Where a separate non-disclosure agreement has been executed in writing between you and Aloha Intech, that agreement governs. We handle any personal information contained in your submission in accordance with our Privacy Policy, and only for the purposes of use stated there.

No Obligation to Respond

We aim to respond to all genuine business inquiries in a timely manner, but we are under no obligation to acknowledge or reply to any submission. Receipt of an inquiry does not constitute a commitment to enter into any business relationship.

No Warranties

The Site is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. Aloha Intech makes no representation or warranty that the Site will be uninterrupted, error-free, or free from viruses or harmful components, or that any information on the Site is accurate, complete, or current.

Information on the Site describing our ventures and services is provided for general informational purposes only and does not constitute an offer, commitment, or guarantee of any specific outcome.

Third-Party Links

The Site may contain links to third-party websites or resources. These links are provided for convenience only. Aloha Intech does not endorse, control, or assume any responsibility for the content, privacy practices, or availability of any third-party site. Your use of linked sites is at your own risk.

Applicable Law

These Terms are governed by and construed in accordance with the laws of Japan, without regard to its conflict-of-law provisions.

Dispute Resolution

Any dispute arising from or relating to these Terms or your use of the Site shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the exclusive jurisdiction of the Tokyo District Court (東京地方裁判所) as the court of first instance.

Nothing in this section prevents either party from seeking injunctive or provisional relief from any court of competent jurisdiction at any time, including to prevent infringement of intellectual property rights or misuse of confidential information. Neither party is required to complete the negotiation period before doing so.

Governing Language

These Terms are published in Japanese and English. The Japanese version is the authoritative text. In the event of any discrepancy or inconsistency between the Japanese and English versions, the Japanese version prevails.

Severability

If any provision of these Terms is held to be invalid, unenforceable, or deemed not to have been agreed, that provision applies to the greatest extent that remains valid, and the remaining provisions continue in full force and effect.

No Assignment

You may not assign or transfer any of your rights or obligations under these Terms to a third party without our prior written consent.

Survival

Sections C (Intellectual Property), D (Inquiries and Contact Form Submissions), E (Disclaimers), F (Limitation of Liability), G (Governing Law and Disputes), and this section H survive any termination of your use of the Site.

Notices

We may give notice under these Terms by posting it on the Site. You may give notice to us in writing at the address or email address set out in section I. Notice posted on the Site is effective when posted; notice sent to us is effective when we receive it.
